Plan terms and questions
What does “website included, $0 upfront” mean?
We design and launch your website with no upfront build fee. You pay $249/month on a 12-month agreement, and that fee covers the build plus hosting, care and updates. From month 13 the fee drops automatically to $199/month, month to month until you cancel.
When does my site go live, and when does my plan start?
Your site goes live within 24 hours after we confirm we have everything we need: your text, logo, photos, services and domain access. Delays at your domain registrar, DNS propagation or other third-party platforms are outside our control and are not counted.
Your plan starts on the Launch Date: the day your site first goes live at your domain. If we deliver a launch-ready site and you neither approve it nor ask for revisions within 10 business days, the Launch Date is the end of that period. Your 12 months, and your first monthly fee, start on the Launch Date. Nothing is charged before then.
What if I want to cancel before 12 months?
If you end your plan before your 12 months are up, you pay a one-time $1,250 early-cancellation fee (the website buyout), the same in every month, and the site is transferred to you. It’s the only charge for leaving early: we don’t collect the rest of your 12 months, and we stop monthly billing once you give notice. Fees billed before your notice still apply. You never have to cancel early: if fewer than $1,250 of monthly fees are left in your 12 months, you can simply finish your term and leave with no fee. Notice that ends your plan at the end of month 12 never carries a fee.
Your plan ends at the end of the month you’ve already paid for when you give notice (or a later date you choose), and no monthly fee is charged after that, so the month you give notice in is never billed on top of the $1,250.
No early-cancellation fee applies if you cancel before the Launch Date, if we stop offering the plan, if we raise your monthly fee, or if we fail to fix a material problem on our side within 30 days of your notice.
If a court or arbitrator ever finds the fee unenforceable, it is reduced to the lesser of $1,250 or the monthly fees that would have come due from your cancellation date through the end of your 12 months.
Why is there an early-cancellation fee?
We do most of the work, and spend most of the cost, of building your site before launch, and we don’t charge that cost upfront. We plan to recover it, together with hosting and care, over your 12 months. If the plan ends early, we lose that planned recovery, and that loss is hard to measure because it depends on the build hours, setup and tools spent on your site. $1,250 is our listed one-time price for the same Website Essentials build, and we both agree it is a reasonable, good-faith estimate of that loss. It is not a penalty and not a charge for your remaining months, which we don’t collect. You can also buy the same build outright for $1,250 instead of choosing this plan.
How do I cancel?
Email hello@ellsworthcapitol.com from your account email with “Cancel Website Plan” in the subject, or use the cancel link in your receipt. Notice is effective when sent. During your first 12 months, your plan ends at the end of the month you’ve already paid for. After that, notice takes effect after 30 days, or at the end of your current billing month if that’s sooner. We confirm in writing within 2 business days with your end date and any fee, and during your first 12 months we also show what it would cost to finish your term instead, so you can pick. Any fee is due within 15 days. Cancelling never requires a call or a meeting.
What happens to my site if I cancel early?
Once the early-cancellation fee is paid, we transfer to you the copyright in the custom design and custom code we created for your site, plus the written content we created for you, and send you a complete export of the site within 5 business days. The same transfer happens when you finish your 12 months with all monthly fees paid.
Third-party themes, plugins, stock photos and fonts transfer only as far as their licenses allow. Where a license doesn’t allow it, we tell you which items are affected so you can buy your own license or have them replaced. Our own reusable tools and templates stay licensed to you so the site keeps working.
We help you move hosting: up to 2 hours of help included; additional help at $75/hour with your written approval first.
Who owns my domain and content?
You do, always. Your domain is registered in your name, and your content (your text, logo, photos and reviews) stays yours. You can get your domain transfer code at any time, whether or not anything is owed. We will never hold your domain back for any reason.
What happens after 12 months?
Your plan continues month to month and the fee drops automatically to $199/month from month 13, until you cancel. Each period is one month. Cancel anytime with 30 days’ notice (or by the end of your billing month, if sooner) and no fee. If we ever raise the month-to-month fee, we’ll email you at least 30 days ahead, and you can cancel before it takes effect.
Which law applies?
These plan terms are governed by Utah law, with exclusive venue in the courts located in Salt Lake County, Utah.
Are SEO and Google Business Profile management included?
No. The $249 and $199 plan prices cover your website only. If you want monthly SEO and Google Business Profile management too, our Website + SEO upgrade is $499/month for months 1–12, then $429/month. Ask us about terms. The plan terms on this page apply to the $249 website plan.
12-month agreement starting on the Launch Date, the day your site first goes live. $249/month for months 1–12, then $199/month automatically from month 13, month to month until you cancel. Ending before your 12 months are up: a one-time $1,250 early-cancellation fee (website buyout), the same in every month; monthly billing stops at your notice, and you may instead finish your term with no fee. Business use only. Notice that ends the plan at the end of month 12 carries no fee, and the remaining months are never accelerated or collected. $1,250 is our listed price for the same build and the parties’ good-faith estimate of the build cost we recover over the term; if ever found unenforceable, the fee becomes the lesser of $1,250 or the monthly fees left in your 12 months. Written notice by email to hello@ellsworthcapitol.com counts. Once the fee is paid, the copyright in the custom design and code we created transfers to you; third-party items transfer only as far as their licenses allow; hosting move help: 2 hours included, then $75/hour with prior written approval. Your domain and your content are always yours. Taxes, out-of-scope work and third-party costs are separate. Utah law; exclusive venue in Salt Lake County, Utah.
